Terms of Service

These Terms of Service ("Terms") govern your use of services provided by WiscAI, LLC. By using our website (www.wiscai.com), calling a business that uses our AI voice receptionist, or otherwise engaging with our services, you agree to these Terms.
1. Service Description
WiscAI, LLC ("WiscAI", "we", "our") provides AI voice receptionist software ("Service") to small service businesses, including veterinary clinics, HVAC contractors, plumbing services, garage door installers, tree care providers, and restoration companies. When you call one of these businesses, our AI receptionist answers your call, helps you book appointments, and may send you confirmation messages via SMS or email.
2. Acceptance
By using this website (www.wiscai.com), you agree to these Terms as they apply to website use. By verbally providing your phone number to our AI receptionist during a call with a participating business, you consent to our SMS Opt-In Policy and our Privacy Policy. Partner businesses that license the Service do so under separate agreement with WiscAI.
3. Acceptable Use
You agree to:
- Provide accurate information when booking appointments.
- Not use our Service for unlawful purposes.
- Not attempt to interfere with, disrupt, or reverse-engineer the Service.
- Not impersonate another person or provide false contact information.
4. Appointment Confirmations
Appointments booked through our Service are subject to the cancellation, rescheduling, and no-show policies of the individual business you called. WiscAI does not set these policies — the business does. We relay them as part of the booking flow.
5. SMS Messaging
By verbally providing your phone number during a call with our AI receptionist, you consent to receive one transactional confirmation SMS at that number per appointment booked. You may reply STOP at any time to opt out of all future SMS. Standard message and data rates from your mobile carrier may apply. See our SMS Opt-In Policy for full details.
6. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.
Our AI receptionist is designed to help with appointment booking and basic information. It is not a substitute for direct contact with the business, professional advice, or emergency services. In any emergency, call 911 or the appropriate emergency line for your area.
7. Limitation of Liability
To the maximum extent permitted by law, WiscAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of or inability to use the Service. Our total liability for any claim arising out of or relating to the Service shall not exceed one hundred US dollars ($100).
The foregoing limitation does not apply to liability that cannot be limited under applicable law, including liability for gross negligence, willful misconduct, fraud, or violations of consumer protection statutes (including the Telephone Consumer Protection Act).
8. Dispute Resolution and Arbitration
Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You and WiscAI waive any right to bring a claim as a plaintiff or class member in a class or representative action.
This clause does not prevent either party from seeking injunctive relief in a court of competent jurisdiction. You may opt out of arbitration by sending written notice to Privacy@WiscAI.com within 30 days of first using the Service.
9. Governing Law
These Terms are governed by the laws of the State of Wisconsin, United States, without regard to its conflict of laws provisions. Any dispute not subject to arbitration under Section 8 shall be brought exclusively in the state or federal courts located in Dane County, Wisconsin.
If the consumer-protection law of your state of residence requires a different forum or governing law for claims by you, that law controls to the extent required.
10. Changes to These Terms
We may update these Terms from time to time. The "Effective Date" above reflects the most recent change. Continued use of the Service after changes constitutes acceptance of the updated Terms.
11. General
These Terms constitute the entire agreement between you and WiscAI regarding the Service and supersede any prior agreements on the same subject. WiscAI may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign without our written consent. If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. WiscAI's failure to enforce any right does not waive that right. Neither party is liable for delays or failures caused by events beyond reasonable control. We may modify the Service or these Terms at any time by posting an updated version with a new Effective Date.
